Padgett Litigation UPDATE 41
03 Feb 2002
Good News!!!
On January 28, 2002, a Report and Recommendation was entered into the Court records in Kentucky by the Domestic Relations Commissioner permanently unrestricting visitation (and contact) between Tom and Laura Padgett's minor son and his father.
A summary of the ten (10) page report noted that Scientologist Laura Padgett and her lawyer failed to prove that Tom, (a declared PTS and SP by church officials,) is in any way harmful to his son, thereby making Laura's claims of him being "unpredictable and unstable" as unfounded and erroneous.
Commissioner Susan McClure supported her decision with the testimony from the minor son Beau who begged the Court for a normal relationship with his dad, and the testimony of expert and material witness Rev. Robert T. Pardon, Director of the New England Institute of Religious Research.
Pardon's testimony included the behavioral issues present from Scientologist's use of "disconnection" as an "informational control" vehicle used by many cults, not just scientology. This was also supported by the expert witness testimony of Dr. Stephen Kent entered into the case last summer.

Commissioner McClure boldly noted a specific schedule of monthly dates and times for Laura Padgett to put her son on plane flights from Nashville, TN to Providence, RI, from now until he reached his 18th birthday - legal age of consent. She even ordered Laura to pay for the transportation costs. It was further specified that the minor Padgett child shall be able to have normal communication with his father on a daily and weekly basis by phone and by e-mail. She further recommended that their son be required to attended some counselling (psychological not dianetic,) to help him sort though his years of having to endure his parents' vast secular differences.
The Report to court also acknowledged that the web site:
http://www.taxexemptchildabuse.net
was not Mr. Padgett's site, simply a 3rd party news and information forum.
Tom's official statement was, "This is a HUGE victory! Not only for the paternal family interests and mine, but for parents around the world battlingly "disconnection" from loved ones and the ravages left behind in the wake of the alternative mental health practice of 'Child Dianetics - Processing of Children.' The courts can NOT force the Scientological beliefs of one parent upon the other and minor children! I am very pleased, but also very tired and saddened it's taken so long for truth and wisdom to surface and prevail. It's been so costly in so many ways - not just money!"
NOTE: This ruling can be appealed by Laura Padgett within the 10 plus 30 day local and state procedural rules. Time will tell if she does.
