The new ruling by Judge Kane followed  the 10th Circuit Court order issued
on September 18,  which place some of the Church's materials under seal by
the 10th Circuit (exhibit 8) were the Scamizdat postings.

These Scamizdat materials under seal in the 10th Circuit are part of the
same materials which Kane has ordered sealed in his current order.

Judge Kane ruled also that the upper level material is to be deleted from
the material returned to FACTNET.

Wollersheim and Penny are ordered NOT to distribute or disseminate any
upper level materials in their possession. So Scamizdat is sealed, and
Penny and Wollersheim ordered to not distribute copyrighted works. Not a
bad order.
