Several days ago, at my personal request, Bob Penny posted a notice
that David Miscavige must appear for deposition in the Lerma case in
Virginia. This was a gross mistake on my part and at this time is not
true.
Without any prior knowledge of or approval from FACTNet's attorneys,
Faegre & Benson and Ross Dixon, I took a draft notice of deposition
for David Miscavige that I received at Faegre & Benson and incorrectly
assumed in spite of ongoing discussion to the contrary that it was
going to be filed very soon.
I was completely wrong in this posting. In my anxiousness and
impatience to bring David Miscavige to the stand to personally answer
for and be held accountable for his RTC raids on FACTNet, I did not
think carefully through the actual facts of that time before I
prematurely requested that Bob post the notice.
I have been under enormous stress lately due in significant part to
recovering from the raid, a severe illness and Scientology's extensive
surveillance and covert operations. While these things do not in any
way excuse my incorrect and inappropriate action, nor do they change
or qualify its complete incorrectness, they may at least give the
reader some context from which I have been operating.
I apologize to ars, the Internet, to David Miscavige and to
Scientology for this incorrect posting. This or anything similar will
not happen again. I personally accept all responsibility and
consequences for this action.
