Item number 22 of the Auditor's Code reads "I promise never to use the
secrets of a preclear divulged in session for punishment or personal
gain."
In light of the audio tape recordings of scientologists doing just that, and
the many court transcripts available on the Internet that cover the
violation of this item, does anyone know whether this item has been
repealed? And if not, would the violation of this item usually result in a
Condition of Ethics? And if so, do you happen to know which Condition?
There's no date on the court document that I've read this Item from, by
the way.

It's still part of the auditor's code, but there is a double standard.
The auditor may not use the preclear's secrets for personal gain, but
he writes what goes on in session for the case supervisor.
Every preclear has both an auditor and a case supervisor.
When a preclear divulges his secrets to the auditor, those secrets are
documented. The church has those documented secrets in its
possession. Should the preclear publicly attack Scientology in some
way, the OSA can access the preclears folders to intimidate the
preclear.

Oh! I just checked "The Creation of Human Ability."
The 1954 Auditor's Code says, "Never use Scientology to obtain
personal and unusual favours or unusual compliance from the preclear
for the auditor's own personal profit."
This book also has "The Code of a Scientologist," which says:
"To refuse to impart the personal secrets of my preclears"
There have been changes made in the Auditor's Code from time to
time. But the last version was done in 1980.

Interesting. So my version _is_ out of date. Still, they both have the same
Items, reworded quite a bit. What constitutes "personal gains" apparently
means that using the materials to blackmail and extort silence is perfectly
allowable.
