The new law permits the subpoena to be issued *without* a judge *or*
a complaint (case number). Of course it appears strange to the
clerk, this is a new law.
You need to make your emergency ex parte motion to the general duty
judge by this morning, and be prepared to call his or her courtroom
deputy to make sure he or she gets it before AT&T gives up your data.
Appealing or making threats to AT&T is *utterly* pointless. Getting a
judge to give you more time is not.
Let me repeat that: Appealing or making threats to AT&T is *utterly*
pointless. Getting a judge to give you more time is not.
The above should not be construed as legal advice but merely as
hypothetical "what I would do" amusing pratfalls. I am not a lawyer.
If you want legal advice, hire one or join the criminal cult of
scientology.
